Screening authorization carries FCRA obligations
If you obtain a consumer report — credit, criminal, or eviction history — for tenant screening, the Fair Credit Reporting Act applies. You need a permissible purpose, the applicant's authorization, and if you take an adverse action based on the report, you must provide an adverse action notice identifying the consumer reporting agency and explaining the applicant's rights to a free copy and to dispute inaccuracies.
Collecting the authorization as its own clearly labeled signature or initials field, rather than folding it into the general application signature, produces a cleaner record of what the applicant actually authorized.
Fair housing applies to the whole process
The federal Fair Housing Act, and state and local laws that often go further, govern what you may ask applicants and how you may evaluate them. Many jurisdictions now also restrict criminal history screening, source-of-income discrimination, and application fees.
Apply the same application form and the same criteria to every applicant. Using one template for everyone is good practice for consistency as well as convenience. These obligations rest with the landlord, not the software — consult counsel about the rules where your properties are.
